Kitten sold as a PET
Breeder Responsibilities:
The Breeder hands over the animal to the Owner with the following documents:
veterinary passport with marks of vaccinations made, recommendations for caring for the animal.
The Breeder undertakes to advise the Owner on the specifics of the care and maintenance of the animal before its transfer.
The kitten is transferred to the future owner no earlier than after reaching three months (12 weeks) of age. In case of dissatisfaction with the acquired animal, as well as in cases of defects in the development of the kitten, its illness, death, theft, disappearance, etc., the buyer (owner) has no right to demand a refund or any other compensation for damages from the breeder.
The kitten or cat/cat cannot be resold, leased or given as a gift to another person or cattery without the written consent of the breeder. The kitten or cat/cat will be kept in an apartment, house or enclosure without free access to the street. The kitten or cat/cat will be regularly (once a year) revaccinated against panleukopenia, rhinotracheitis (herpes virus) or colicivirus. In the event of loss of this kitten or cat/cat due to illness, accident, theft, etc., the buyer/recipient undertakes to inform the breeder about it. The buyer/recipient is considered the full owner of the kitten and bears full responsibility for it from the moment of signing this agreement.
The Seller guarantees that the kitten meets the quality specified in this Agreement at the time of sale and does not provide any guarantees for the future regarding its show career and reproductive qualities. The Seller has the right to visit the sold kitten to check the conditions of its maintenance, development of breeding characteristics. If the Seller becomes aware of the poor physical or unkempt condition of the animal, or of facts of cruel treatment, the kitten is subject to immediate return to the Seller without reimbursement of amounts previously paid by the Buyer.
On the day of sale, the kitten is dewormed, vaccinated against infectious diseases, which is reflected in the veterinary passport, which is attached to this Agreement. The Buyer confirms that the Seller has given comprehensive recommendations on feeding and maintenance of the kitten. The Seller, in turn, undertakes to provide the Buyer with further advisory assistance on the maintenance of the animal.
The health guarantee is valid for three days after transfer, if the cat/kitten is examined by a licensed veterinarian during this time.
During this period, the cat/kitten must be isolated from other animals to maintain the guarantee.
If the veterinarian finds a health problem, the Buyer must contact us immediately and provide a written statement from the veterinarian.
The Buyer is responsible for any medical costs and decisions after purchase.
In the event that the cat/kitten is found to have been neglected or not properly cared for, or if the terms of the contract are violated, the cattery has the right to protect the animal.
In the event that an incurable or life-threatening condition is discovered in the kitten, we will consider replacing the kitten or refunding the money, provided that the cat/kitten is returned with the appropriate medical documentation.
If a replacement is not possible at this time, we will provide a replacement within 6 months.
We do not guarantee that the kitten will be free of coronavirus titers, but we do test the parents for viruses to minimize the risk.
If the kitten is diagnosed with FIP within the first year, we will provide a replacement (no refund).
In the event of fatal birth defects within the first year, a replacement or refund may be possible at the discretion of the cattery, provided that all medical documentation and a certificate of cause of death are provided.
The buyer is obliged to avoid contact of the cat/kitten with animals that have not passed the infection test in order to maintain the health guarantee.
The cattery's liability is limited to replacement or refund; medical expenses are not covered.
The Buyer agrees to isolate the cat/kitten from other animals in the house for 2-4 weeks. If the animal is in contact with other pets or is outdoors, the health guarantee is void.
The buyer agrees to bring the cat/kitten to a licensed veterinarian for examination within 72 hours of receipt to confirm the health guarantee.
The buyer agrees to allow the cat/kitten time to adapt to the new home and understands that the adjustment process may take time. The buyer understands that he/she is responsible for informing family members or guests about possible allergies or other medical conditions that may be affected by the presence of the cat/kitten. In the event of any difficulties with this cat/kitten in the Buyer's home, our cattery is ready to help with finding a new home. No refunds will be given. The cat/kitten shows no signs of illness at the time of transfer.
The cat/kitten has received the first combination vaccine and any additional vaccinations listed on the health card. (Further vaccinations are required to maintain health.)
Breeder gives a guarantee of health for a 1 year.
In the event of the death of an animal as a result of a congenital defect, within 30 days from the moment the animal moved to the Owner, recorded by a licensed veterinary clinic and documented, the Breeder provides the Owner with another healthy animal equivalent to the deceased.
In the event of an emergency at the Owner (allergies among family members, moving with the inability to take the animal with him, any illness of the Owner, other circumstances), the Breeder undertakes to assist in finding new owners for the sold animal without reimbursement of its cost to the Owner.
Obligations of the Buyer: The Owner undertakes to provide the animal with proper, complete nutrition and care, timely veterinary care, examination and treatment. The animal must not be caged or allowed to roam freely outside.
In the event of the death of an Animal as a result of a genetic (congenital) defect under the age of 1 year, the genetic nature of the disease must be confirmed in writing by a pathoanatomical report from the state veterinary clinic. The Seller undertakes to provide the Buyer with another Ragdoll Animal free of charge within 6 (six) months after receiving a notarized copy of the pathological report.
If the animal is sold with the right of breeding use, the Owner undertakes not to mate it until it reaches the permissible age, not to mate with cats (cats) of other breeds and with animals without breeding documents. It is desirable that the animal sold for breeding should attend exhibitions. The owner is warned that the maintenance of full-fledged producers is complicated by the possibility of tags and increased loudness.
If the animal is sold without the right of breeding, the Owner undertakes to castrate (sterilize) it before it reaches 9 months. age. In case of violation of the breeding ban, the Owner shall pay the Breeder a monetary penalty in the amount of 5000 US dollars, regardless of the value of the animal.
By signing this agreement, the Owner confirms that the Breeder has given comprehensive recommendations on keeping and feeding the animal.
The breeder has the right:
be interested in the health status of the animal and the conditions of its keeping in the new home, the implementation of the indicated recommendations for feeding / caring for the animal in the first month after its transfer to the Owner.
In the event that the sold animal is noticed by the Breeder in a bad and neglected condition, or the Breeder becomes aware that it has been subjected to obvious physical violence, the animal with all documents is subject to a trouble-free return, without reimbursement of its cost.
The owner has the right:
within 3 working days, check the health of the animal at a licensed veterinary institution at their own expense.
The Breeder undertakes to accept the animal back with a one-time refund of the full cost of the animal within 14 (fourteen) days from the date of sale, with the Owner presenting a veterinary certificate from a licensed veterinary laboratory confirming that the animal has an incurable disease that can lead to the death of the animal (diseases associated with improper keeping and feeding the animal after the moment of purchase).
The return of the animal is at the expense of the Owner.
If the Owner has not exercised the right, claims for the condition of the animal will not be accepted in the future and a refund after a fifteen-day guarantee given by the Breeder is excluded.
If a reserve is made for a kitten, the Owner has the right to request a photo and video of the kitten from the Breeder, to be interested in its growth, development and health.
IT IS FORBIDDEN:
- remove claws and vocal cords by surgery (except for medical indications),
- euthanize an animal without urgent medical indications,
- sell, resell the animal to third parties without notifying the Breeder,
- donate to a shelter or experimental laboratory.
Additional terms:
• We reserve the right to use photos of the cat/kitten in advertising materials, including the cattery website.
• The buyer agrees to the use of the name and photos of the cat/kitten in advertising without compensation.
• This agreement is legally binding and applies only to the Buyer and our cattery within the framework of this transaction.
Delivery is paid by the Owner and is not included in the cost of the animal (except in some cases by mutual agreement).
When reserving an animal, the Owner voluntarily makes an advance payment of 300 US dollars.
When making an advance, the Breeder guarantees that the kitten will not be sold to another buyer, the Owner undertakes to pick up the animal no later than the agreed time.
If the Owner refuses the kitten when it reaches 2 months, for reasons beyond the control of the Breeder, the advance payment is not refundable.
If the Owner does not accept the kitten before the end date, the Breeder reserves the right to terminate this agreement unilaterally. The advance is not refundable.
This agreement is made in 2 copies, having equal legal force, one copy for each of the parties and comes into force from the moment of its signing.
The signatures of the Buyer and the Breeder certify their full agreement with all the terms of this agreement.
Any disputes arising under this agreement, the parties are trying to resolve peacefully and on their own.
